It can be intimidating to come forward as a whistleblower. Many fear retaliation and worry that they may lose their job or reputation in an effort to expose wrongdoing. Seeking the support and guidance from an experienced Pittsburgh, PA federal whistleblower lawyer can set your mind at ease and protect your rights throughout the legal process. The brave actions of whistleblowers have an important impact on policy, reform, and justice.
Thanks to a whistleblower, Morcon Construction Company, Inc. was exposed for concealing its use of subcontractors, falsely certifying work as self-performed, and submitting falsified invoices. Morcon Construction was contracted to conduct repair and maintenance work for the U.S. Postal Service.
During the case, it was uncovered that Morcon Construction had falsely claimed self-performed work since 2016. Their non-disclosure of subcontracted work violated the terms of their contract. The misconduct resulted in millions of dollars in improper payments by the Postal Service.
The investigation was triggered by a whistleblower whose information led to a federal investigation by the U.S. Attorney’s Office and the U.S. Postal Service Office of Inspector General. Investigators determined that Morcon intentionally failed to disclose subcontracting arrangements and inflated costs, undermining the integrity of government contracting.
On January 13, 2025, the Department of Justice (DOJ) released a press release stating that an agreement was reached with Morcon Construction. The $5.9 million settlement includes triple damages, with nearly $3 million returned directly to the Postal Service. This case is an example of the DOJ’s commitment to holding contractors accountable for fraud against the U.S. government.
Had the whistleblower in the Morcon case not come forward, it is unknown if Morcon Construction’s abuse of its government contract would have ever been realized. As whistleblower attorneys, we know that one of the biggest questions clients face is how to safely and legally gather evidence to support their claims. In a recent article published by TAF Coalition, our founding attorney, Darth Newman, shared some practical, experience-driven advice for whistleblowers on exactly that.
The key takeaway? Be strategic, cautious, and honest. Take only what evidence you need, and only what you can access through the normal course of your job. Taking too much or accessing systems you're not authorized to use can backfire and potentially jeopardize your case.
Darth also reminds whistleblowers to be aware of privilege issues, especially when corporate attorneys are involved, and to resist the urge to talk about their case with friends, co-workers, or anyone outside their legal team. Sharing too much—even with good intentions—can put both you and your claim at serious legal risk.
